میان کنش حق بر بدن زوجه و اختیارات زوج در عمل های جراحی زیبایی

چکیده
هدف: عمل جراحی زیبایی ازجمله مسائل مستحدثه در فقه است که به شکل کنونی در عصر معصومین مطرح نبوده ولی می‌توان احکام آن را از میان قواعد فقهی و متون روایی استنباط کرد. شیوع این رویداد میان زنان و تعارضاتی که بین زوجین از قبل آن حاصل می‌شود بیانگر هدف از انتخاب این موضوع است.
مواد و روش: این پژوهش، با بهره‌گیری از آیات و روایات، داده‌های کتابخانه‌ای و نرم‌افزاری را به‌صورت توصیفی و تحلیلی پردازش کرده است.
یافته‌ها: دانشمندان فقه پیرامون جواز جراحی زیبایی نظرات مختلفی بیان نمودند که با تبیین ادله فقها می‌توان دریافت که جراحی زیبایی وجهی از تغییر خلقت بشمار نمی‌آید و با بهره‌گیری از منابع نقلی مشروعیت آن قابل استنتاج است.
همچنین قوامیت زوج در نصوص دینی به معنای سلطه گری نیست بلکه به‌مقتضای مسئولیت مرد مدیریت خانواده را به دنبال دارد که این امر تعارضی با حق بر بدن زوجه ندارد.
 نتیجه‌گیری: بر اساس قاعده فقهی تسلیط زوجه حق سلطه بر بدن خود را داراست و قوامیت زوج بر اعطای مسئولیت و مدیریت مرد منافاتی با اختیار زوجه بر بدن خود نداشته و اصل، عدم ولایت مرد است البته این استقلال زوجه تا جایی وارد است که مانع حق استمتاع جنسی شوهر نشود.
