Abstract
Purpose: Publicizing economic criminals in the current era is
the best punishment for economic disruptors and can be
effective in reducing such crimes, which this article has
examined from a jurisprudential perspective with a
descriptive-analytical approach and library method.
Materials and methods: Considering the importance of this
topic, this research was conducted using Islamic sources,
jurisprudence and law books in a descriptive-analytical way.
Findings: Defamation is one of the types of Ta'ziri
punishments, which according to the Qatabah of jurists is the
main punishment for the crime of forced martyrdom, and
according to famous jurists, it is also applied to Qadzf, Qawad,
swindlers and bankrupts. There are differences of opinion
among the jurists about the philosophy, cases and quality of
the implementation of tashir.
Conclusion: The sentence of defamation for economic
disruptors is a punishment that most Islamic jurists consider to
be the best punishment for economic criminals in the current
situation, using verses and traditions, both in Imami and Sunni
jurisprudence, with the aim of deterring and preventing the
repetition of crimes. It is economic and all jurists agree on this
issue.
