The Role of Time and Place in the Evolution of Issues and Change in the Jurisprudential Rules of Khums with Emphasis on the Opinion of Imam Khomeini

Abstract
According to the popular Shiite view, khums is a right that God has 
imposed on people's property in favor of Bani Hashim, but Imam 
Khomeini believes that: Khums is a single property and has a single 
owner; It is the owner of God Almighty. The meaning of time and 
place is considered by some requirements of time and place, which 
means that the real needs change over time and every human need 
is a kind of demand. Human thoughts and actions, and changes and 
historical and natural events are influenced by political (internal and 
external), social and economic relations, and affect the subjects and 
examples and inference of jurisprudential rules. Shari'a rulings in a 
general division can be divided into three categories: "primary 
rulings", "secondary rulings" and "government rulings" that time 
and place play a role in all three categories, especially the third 
category, the effect of time and place in many It is one of the obvious 
and tangible sciences. This meaning is so clear in the experimental 
and human sciences that it does not need to be explained or 
allegorized. Even time and place play an important role in some nontheoretical divine sciences, such as practical mysticism. Khums is 
one of the rulings that can be said that the conditions of time and 
place in his belongings, especially in its consumption, has a great 
impact.
