Abstract
Purpose: The aim of this study was to investigate the gaps in Iran's substantive criminal policy in the field of environmental crimes in order to maintain environmental health. Materials and Methods: This research was conducted by library study method and descriptive-analytical method. Findings: The findings showed that in the Iranian penal system, in order to "achieve the goals of criminal policy against environmental crimes, several criminalizations have been carried out in different annual periods." Although this level of criminalization and the punishments imposed on them indicate the legislator's concern for criminal protection of a healthy environment, there are many gaps in the field of criminalization and punishment. Conclusion: According to the studies, Iran's substantive criminal policy in the field of criminalization and punishment has many gaps regarding the predicted crimes: inconsistency of laws, general, general and sometimes vague laws, lack of social performance guarantees, lack of deterrence Guarantees of executions against natural and legal persons, criminalizations related to obtaining the result and committing crimes with a positive act can be seen
