Journal Article 2023 12 29 Purpose: Publicizing economic criminals in the current era is the best punishment for economic disruptors and can be effective in reducing such crimes, which this article has examined from a jurisprudential perspective with a descriptive-analytical approach and library method.<br />Materials and methods: Considering the importance of this topic, this research was conducted using Islamic sources, jurisprudence and law books in a descriptive-analytical way.<br />Findings: Defamation is one of the types of Ta'ziri punishments, which according to the Qatabah of jurists is the main punishment for the crime of forced martyrdom, and according to famous jurists, it is also applied to Qadzf, Qawad, swindlers and bankrupts. There are differences of opinion among the jurists about the philosophy, cases and quality of the implementation of tashir.<br />Conclusion: The sentence of defamation for economic disruptors is a punishment that most Islamic jurists consider to be the best punishment for economic criminals in the current situation, using verses and traditions, both in Imami and Sunni jurisprudence, with the aim of deterring and preventing the repetition of crimes. It is economic and all jurists agree on this issue. هدف: تشهیر مجرمان اقتصادی در عصر حاضر، بهترین مجازات اخلال‌گران اقتصادی است و می‌تواند در زمینه کاهش این گونه جرایم مؤثر باشد که مقاله حاضر با رویکرد توصیفی – تحلیلی و با روش کتابخانه‌ای آن را از منظر فقهی مورد بررسی قرار داده است.<br />مواد و روش: با توجه به اهمیت این موضوع، این تحقیق با استفاده از منابع اسلامی، فقهی و کتب قانون به شیوه توصیفی-تحلیلی انجام شد.<br />یافته ها: تشهیر یکی از انواع مجازات‌های تعزیری است که به اعتقاد قاطبه‌ی فقها مجازات اصلی جرم شهادت زور است و از نظر مشهور فقها در مورد قاذف، قوّاد، کلاهبردار و مفلس هم اجرا می‌شود. در مورد فلسفه، موارد و کیفیت اجرای تشهیر بین فقها اختلاف نظرهایی موجود است.<br />نتیجه گیری: حکم تشهیر برای اخلال‌گران اقتصادی مجازاتی است که اکثر فقهای اسلامی آن را با استفاده از آیات و روایات برای مجرمین اقتصادی در شرایط فعلی بهترین مجازات می‌دانند که هم در فقه امامیه و هم در فقه اهل سنت با هدف بازدارندگی و جلوگیری از تکرار جرایم اقتصادی بیان شده و همگی فقها بر این مسئله اتفاق‌نظر دارند. https://www.islamiilife.com/article_186224_b77be34d0ba69d36d51360cee54f80c4.pdf
